LEGIER FILMS SL operates the brand "The Film VFX" ("we", "our", "us"), including the website, API, and visual effects plugins for Adobe After Effects, DaVinci Resolve Studio, and Avid Media Composer (collectively, the "Service").

This information is provided in compliance with Article 10 of Ley 34/2002, de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE).

2. Acceptance of Terms

By accessing or using the Service, you ("User") agree to be bound by these Terms and Conditions, our Privacy & Data Protection Policy, and any additional guidelines incorporated by reference. If you do not agree, you must not use the Service.

These terms constitute a legally binding agreement between you and LEGIER FILMS SL under Spanish and European Union law.

3. Service Description

The Film VFX provides AI-powered visual effects processing through plugins compatible with industry-standard video editing software. The Service operates on a prepaid credit-based system where users purchase credits to process visual effects on their video footage.

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with reasonable prior notice where feasible.

4. Account Registration

• You must provide accurate, complete, and up-to-date information when creating an account.
• You are solely responsible for maintaining the confidentiality and security of your account credentials.
• You must be at least 16 years of age (or the age of digital consent in your jurisdiction) to create an account. Users under 18 must have parental/guardian consent.
• One account per natural person — creating multiple accounts is prohibited and may result in termination.
• You must notify us immediately at support@thefilmvfx.com if you suspect unauthorised access to your account.

5. Credits, Pricing and Payments

• Credits are purchased in advance and consumed when processing visual effects.
• Credits never expire and remain valid for the lifetime of your account.
• All payments are processed securely by Stripe Inc. We do not store your payment card details.
• Prices are displayed in Euros (EUR). All prices include applicable taxes (VAT/IVA) for EU consumers as required by Directive 2011/83/EU.
• Credits are non-transferable between accounts.
• We reserve the right to modify prices with 30 days' prior notice. Price changes do not affect previously purchased credits.

6. Right of Withdrawal and Refund Policy

In accordance with Article 103 of Real Decreto Legislativo 1/2007 (Ley General para la Defensa de los Consumidores y Usuarios) and Article 16(m) of Directive 2011/83/EU:

• Unused credits: You may exercise your right of withdrawal within 14 calendar days of purchase if no credits have been consumed. To exercise this right, send a clear statement to support@thefilmvfx.com.
• Used credits: Once you begin consuming credits (i.e., processing visual effects), you acknowledge that the digital content has been supplied and the right of withdrawal is lost, provided you gave prior express consent and acknowledged this loss.
• Refunds will be processed using the same payment method within 14 days of receiving your withdrawal request.

7. Acceptable Use

You agree not to:

• Use the Service to generate, process, or distribute illegal, harmful, defamatory, obscene, or abusive content
• Generate deepfakes or manipulated media intended to deceive, defraud, or harm individuals
• Attempt to reverse-engineer, decompile, disassemble, or extract our AI models or proprietary technology
• Use automated tools, bots, or scripts to abuse, scrape, or overload the Service
• Resell, sublicense, or commercially redistribute credits or access to the Service without written authorisation
• Upload content that infringes on third-party intellectual property, privacy, or publicity rights
• Circumvent or attempt to bypass security features, rate limits, or access controls
• Use the Service in violation of any applicable law or regulation

Violation of these terms may result in immediate account suspension or termination without refund.

8. Intellectual Property

• Your content: You retain all intellectual property rights to your original footage and media. You are solely responsible for ensuring you have the rights to process the content you upload.
• Output: AI-generated visual effects applied to your footage are yours to use, including for commercial purposes, subject to applicable intellectual property laws.
• Our property: The Film VFX software, brand, trademarks, AI models, source code, website design, and all underlying technology are and remain the exclusive intellectual property of LEGIER FILMS SL. No licence to these assets is granted beyond what is necessary to use the Service.

9. Service Availability and Warranty Disclaimer

We strive for high availability but provide the Service on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

• Uninterrupted or error-free service availability
• Specific AI-generated results, quality, or accuracy
• Compatibility with all hardware or software configurations

Scheduled maintenance will be communicated in advance when feasible.

10. Limitation of Liability

To the maximum extent permitted by applicable law, including Articles 1101 et seq. of the Spanish Civil Code:

• LEGIER FILMS SL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Service.
• Our aggregate total liability for any claims shall not exceed the total amount paid by you in the 12 months immediately preceding the event giving rise to the claim.
• Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

• You may delete your account at any time by contacting support@thefilmvfx.com.
• We may suspend or terminate your account immediately if you breach these Terms, with notice except in cases of serious violation.
• Upon termination: unused credits are forfeited (unless a refund applies under Section 6), your personal data will be handled in accordance with our Privacy Policy, and your licence to use the Service ceases immediately.

12. Force Majeure

We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, cyberattacks, pandemics, or third-party service outages.

13. Modifications to Terms

We may modify these Terms at any time. Material changes will be notified via email or a prominent notice on the website at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree with the updated terms, you must stop using the Service and may request account deletion.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Kingdom of Spain and applicable European Union regulations.

For consumers: Any dispute shall be submitted to the courts of the consumer's place of residence, in accordance with Article 52 of Ley 1/2000 de Enjuiciamiento Civil and Regulation (EU) No 1215/2012 (Brussels I Recast).

For business users: Any dispute shall be submitted to the courts of Madrid, Spain.

In accordance with Regulation (EU) No 524/2013, we inform you of the existence of the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, said provision shall be modified to the minimum extent necessary to make it valid, or severed, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy & Data Protection Policy, constitute the entire agreement between you and LEGIER FILMS SL regarding use of the Service and supersede all prior agreements and understandings.
